The book takes the position that such criticisms are warranted and that the ICJ's current approach to fact-finding falls short of adequacy, both in cases involving abundant, particularly complex or technical facts, and in those involving a scarcity of facts. James Gerard Devaney holds a PhD from the European University Institute in Florence, Italy. His doctoral research focused on international courts and tribunals, but he has published on a wide range of areas of international law, including state immunity, genocide, self-defence and the use of force, the law of the sea, and state succession to treaties. He currently teaches at the University of Glasgow.
